ACCEPTANCE OF TERMS & OTHER AGREEMENTS

By using this website (the “Site”), and our services, you are agreeing to the following Terms and Conditions (the “Terms”), which govern your use of this Site and the rental of our vehicles.

Our reservations are handled on the Site through Outdoorsy and Wheelbase.  When you rent a vehicle from us, you will be required to sign an Outdoorsy RV Rental Contract when you make the reservation and our Wonderland Expedition Rig Rules & Check-out Agreement at pick-up.  Your rental of our vehicles is also subject to Outdoorsy’s Terms of Service .

DRIVERS & LICENSES

All drivers must be at least 25 years of age with a valid driver’s license. Outdoorsy completes a DMV check on all drivers to ensure you meet minimum requirements.  International drivers need an International Driver’s Permit (IDP) and current passport. Insurance is required for all rentals and must be purchased through Wonderland Expeditions or may be acquired via a binder on your own personal insurance.  Proof of insurance is required at pick-up.

VEHICLE RESTRICTIONS

Our vehicles may be used on dirt roads and backcountry trails, BUT ARE NOT to be used for serious "rock-crawling" or in designated off-road vehicle parks. They are also NOT allowed to be driven in soft sand, salt or brackish water. The use of our vehicles in these applications and settings is strictly PROHIBITED and you will be liable for any and all damages to the vehicle, tires, and additional equipment, at Wonderland Expeditions' discretion. Additional fees related to misuse and abuse of the vehicle and equipment will be determined at our discretion. Towing charges and any additional expenses resulting from breakdown or accident will also be your responsibility. Travel within the US and Canada is permitted. Travel into Mexico is currently prohibited. The consumption of alcohol or intoxicants while operating any vehicle is prohibited. NO climbing on the roof or hood of vehicle for Instagram photos or for any other reason. 

RESERVATION DEPOSIT & PAYMENT

A reservation deposit of 50% of the total rental is required to secure your booking. Your reservation is not secured until this deposit has been made. Full payment of the remaining rental balance and the security deposit is required one day prior to pick-up. We accept credit and debit cards for rental charges and purchase must be made through our website. 

SECURITY DEPOSIT & DAMAGE TO VEHICLES

You will be charged a $1000 - $2500 security deposit (amount depends on the vehicle) along with your final payment the day before your scheduled pick-up. This amount is equal to the insurance deductible. Your deposit will be returned – after deduction of any damages, mileage overages and additional fees - within seven days after the vehicle is returned.

You agree to use the utmost standard of care in your operation of the vehicle and to comply with these Terms and the Outdoorsy RV Rental Contract at all times.  In the event of an accident or damage to the vehicle that requires an insurance claim, your security deposit will be used as the deductible for the insurance claim, which is 2% of the replacement cost of the vehicle. If the resulting damage is less than the deductible, the security deposit will be used to cover the cost to repair the damage.

Insurance does not cover interior damage, mechanical damage, administrative costs, or loss of income due to repair time. In the event that there is damage or loss of income not covered by insurance, we will use the security deposit to cover these costs, at our discretion. If the damage is greater than the security deposit, you agree to pay for and will be billed for the excess amount.

You are responsible for any damages or other liabilities caused by your guests. In the event that damage to the vehicle is due to your or your guests’ negligence, insurance may deny your claim and you agree to pay and will be charged the full amount of the damage to cover the repairs and loss of income.

In the event that the vehicle is returned excessively dirty, we will use the security deposit to pay for additional cleaning fees.  The amount and under what circumstances we charge for excessive uncleanliness is determined at our sole discretion.

CANCELLATION POLICY

All cancellations must be submitted in writing to Wonderland Expeditions. Wonderland Expeditions reserves the right to cancel a reservation at our discretion, at which point you will receive a full refund.

- A $200 processing fee applies to cancellations over three months (90 days) prior to the pick-up date.

- Cancellations between two weeks (14 days) and three months (90 days) of pick-up will be charged the 50% deposit.

- Cancellations within two weeks of pick-up (or no show) will be charged 100% of the rental cost.


MILEAGE ALLOWANCE AND FEES

All of our rentals include 150 miles FREE per day. Additional mileage blocks of 100 miles can be purchased for $25 per 100 miles. Travel over 150 miles not already paid for will be charged at a rate of $0.35/mile upon your return.

GAS

Rentals come with a full tank of gas.  Please return the tank full, otherwise we will deduct this from your security deposit at a rate of $5 per gallon.

PROPANE

Your rental will come with a full tank of propane for cooking (and heating in pop-up campers). Depending on the length of your trip, you may need to refill along the way. Training will be provided upon pickup and instructions will be included in each rental. No need to return the vehicle with a full propane tank, we'll take care of it!

CLEANING / COSMETIC DAMAGE FEES

Rentals that come back excessively dirty (covered in mud, food remnants / stains inside) or excessively scratched from shrubs and trees from driving down too narrow of trails will be charged a minimum of $100 at our discretion for additional time spent for cleaning, professional cleaning, detailing or paint repair. Damage or dirtiness from unapproved pets or pets not restricted to a soft-crate or similar will result in a minimum $250 fee and you will be responsible for all professional cleaning and repair costs.

DRIVING FINES, TOLLS AND FEES

If they happen on your watch, then they are yours to pay.  You will be charged for any fines, tolls, or fees passed along to us that were not paid during your rental.

SMOKING

Smoking is NOT allowed in any part of the vehicle. 

GPS TRACKING

Our vehicles come with GPS tracking. By renting from us, you are allowing us to the track location of the vehicle at any point. This is for your safety as much as anything. However, if you are found to be speeding excessively, we reserve the right to charge a fee for excess wear and tear at our discretion. This will be taken out of your security deposit.  

INDEMNIFICATION

You agree to indemnify, defend, and reimburse us, and our members, officers, agents, successors, and assigns, from any and all disputes, actions, suits, claims, damages, losses, fees or costs, including reasonable attorney’s fees and costs, arising from or related to your breach of these Terms or your breach of our Rental Check-out Agreement.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event will Wonderland Expeditions, or its members, officers, successors, or assigns, be liable to you or any third party for lost or damaged data, substitute goods, lost profits, interruption of business, or any special, indirect, consequential, punitive, or incidental damages, however caused, whether based on contract, negligence, strict liability in tort, warranty, or any other legal theory, even if the party has been advised of the possibility of such damages.  You agree that the foregoing limitations will apply even if the above-stated remedy fails its essential purpose.  We do not warrant that the Site will be provided error-free, uninterrupted, secure, or virus-free, and provide the Site and its content on an as is basis. 

INFORMATION WE COLLECT

We collect users’ first and last names and email addresses when they sign up for our newsletter.  Wonderland Expeditions does not collect or store any other personal information of its users or renters.  Personal data and credit card information is collected by Outdoorsy during the reservation process and Outdoorsy’s use of same is governed by its privacy policy and terms of service. 

GENERAL PROVISIONS

The Site, all content on our Site, including our trade name and trademarks, are proprietary to Wonderland Expeditions.  These Terms constitute the complete and final agreement between you and us and supersede any prior or other oral or written agreements.  We may modify these Terms at any time without notice to you.  The headings contained in these Terms are inserted for the convenience only and shall not be interpreted to alter or otherwise effect these Terms.  Your use of this Site and our services and these Terms are governed by the laws of the State of Oregon, without regard to Oregon’s conflict-of-laws principles. You agree that any claim asserted in any legal proceeding between us shall be commenced and maintained exclusively in state or federal court located in Multnomah County, Oregon.  You agree to submit to the jurisdiction of such courts over you personally in connection with such litigation, and waive any objection to venue in such courts and any claim that such forum is an inconvenient forum.  Any waiver must be in writing.  A waiver of any right, default, or provision of these Terms shall not be deemed a continuing waiver or a waiver of any other default or term.  Any portion of these Terms that is deemed invalid or unenforceable in any jurisdiction shall not render invalid or unenforceable the remaining Terms or otherwise affect the validity or enforceability of the remaining Terms.  In any proceeding to enforce or interpret these Terms, the prevailing party shall be entitled to recover from the losing party reasonable attorney fees, costs, and expenses incurred by the prevailing party before and at any trial, arbitration, or other proceeding, and in any appeal or review.  Our performance of any obligation to you shall be excused or rescheduled if prevented by any act of “force majeure,” including acts of God, government or public enemy, fire or other casualty, labor dispute, or, without limiting the generality of the foregoing, any circumstance beyond our reasonable control.
